1. Who we are

Simple Brain Games ("we", "us") is a game studio based in the United States. For questions about this policy or your data, email support@simplebrain.app.

2. Information we collect

• Your game progress, saved on your device and with the platform you play on (for example, CrazyGames).
• Leaderboard data: a scrambled player ID, a player code, your player name and picture, your scores, hearts and rewards, and when you were last active. The scrambled ID is made from your platform account ID or a random device ID. We never store the ID itself.
• If you log in with a platform account, such as CrazyGames, the platform gives us your account ID, username and profile picture.
• Data that helps us stop cheating and abuse, such as a scrambled version of your IP address that changes every day.
• Messages you send us by email.

We don't collect your real name, location, contacts or advertising ID. Where a game offers purchases, the platform processes them, and we never receive your payment card details.

3. How we use information

• To run our games, save your progress and run leaderboards.
• To prevent cheating, abuse and security problems.
• To answer your messages and comply with the law.

4. Leaderboards

Some of our games have a leaderboard, such as Mewdoku's daily Yarn Cup. Players on your leaderboard can see your player name, picture, score, rank and hearts, and when you were last active. Some players on the leaderboard are computer players. You can hide yourself in the game's Settings. If you type a name, don't use your real name.

5. Legal bases

Where the GDPR or similar laws apply, we rely on performing our contract with you (running the game you chose to play), our legitimate interest in keeping our games fair and secure, and complying with legal obligations.

6. When we share information

We share information only with the companies that help us run our games: Cloudflare, which hosts our servers, and the platforms our games run on, such as CrazyGames. Platforms may also show ads under their own policies. These companies act as our processors or as independent controllers under their own policies. We may also share information when the law requires it. We do not sell personal data.

7. Data retention

We keep personal data only as long as we need it. Leaderboard results are deleted automatically after 30 days, and a player's profile 180 days after their last visit. Records that help us stop cheating and abuse are kept for up to a year.

8. International transfers

We are based in the United States, and so are our servers. If you play from another country, your data is processed in the United States. Where required, we use appropriate safeguards for international transfers, such as adequacy decisions or approved contractual protections.

9. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, restrict, object to, or receive a copy of your personal data. You may also complain to your local data protection authority.

To delete your leaderboard data, open the game's Settings and tap "Delete my Yarn Cup data". For any other request, email us your player code, which you'll find in Settings. See Delete your data.

10. Children's privacy

Our games are for a general audience. We don't ask for your age, email address or real name. If you believe a child has given us personal data, contact us and we'll delete it.

11. Security

We use reasonable technical and organizational measures to protect personal data, such as storing scrambled IDs instead of real ones. No method of storage or transmission is completely secure.

12. Third-party services

Our games run on third-party platforms and services, which have their own privacy policies: CrazyGames and Cloudflare.

13. Changes to this policy

We may update this policy. We'll post the new version here and update the date above.

1. Who may use the Services

You may use the Services only if you can legally enter into these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and accept these Terms for you. You are responsible for making sure your use is allowed by applicable law and any platform rules.

2. Limited license

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services for lawful, non-commercial entertainment, subject to these Terms. The Services are licensed, not sold.

3. Acceptable use

You must not:

• Cheat, exploit bugs, use unauthorized automation, or interfere with fair play.
• Reverse engineer, modify, distribute, sell, rent, or create derivative works from the Services, except where applicable law expressly allows it.
• Disrupt, overload, damage, or gain unauthorized access to the Services, systems, or other users' data.
• Use the Services for unlawful, fraudulent, abusive, hateful, threatening, or infringing activity.
• Choose a player name that is offensive, impersonates someone, or shares personal information. We may change or remove such names.
• Impersonate another person or misrepresent your affiliation with us.

4. Accounts

Our games don't have accounts of their own. If you log in with a platform account, such as a CrazyGames account, that platform's terms apply to it, and you are responsible for keeping it secure.

5. Leaderboards and rewards

Some of our games have leaderboards, such as Mewdoku's Yarn Cup. Leaderboards may include computer players. Leaderboard rewards are virtual items. We may remove results, rewards or players from a leaderboard when we believe cheating or misuse was involved.

6. Virtual items and in-app purchases

Some Services may offer virtual currency, boosts, subscriptions, or other digital items. Virtual items have no real-world monetary value, cannot be exchanged for cash, and are licensed for use only within the applicable Service. We may change or discontinue virtual items where reasonably necessary.

Purchases are normally processed by the store or platform where you access the Service. Pricing, billing, cancellations, and refunds are subject to that platform's rules and applicable consumer law. Nothing in these Terms limits refund or other rights that cannot legally be excluded.

7. Advertising and third-party services

The Services may contain advertising or links to third-party services. We do not control third-party content, availability, or practices. Your use of those services may be governed by separate terms and privacy policies.

8. Intellectual property

The Services, including software, gameplay systems, graphics, characters, names, logos, audio, text, and other content, are owned by Simple Brain Games or our licensors and are protected by intellectual-property laws. Except for the limited license above, no rights are transferred to you.

If you send us suggestions or feedback, you allow us to use them without restriction or compensation, provided we do not publicly identify you without permission.

9. Updates and availability

We may update, modify, suspend, or discontinue all or part of a Service. We do not promise that every Service or feature will always be available, error-free, or compatible with every device. When practical, we will consider the impact of material changes on users.

10. Suspension and termination

We may restrict or terminate access when we reasonably believe these Terms were violated, the Service is being misused, or action is needed to protect users, third parties, or the Services. You may stop using the Services at any time. Provisions that by their nature should continue after termination will remain in effect.

11. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available". We do not make warranties beyond those that cannot legally be excluded. Your statutory consumer rights remain unaffected.

12. Limitation of liability

To the fullest extent permitted by law, Simple Brain Games will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, data, or goodwill arising from your use of the Services. We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, intentional misconduct, or death or personal injury caused by negligence.

13. Governing law and disputes

These Terms are governed by the laws of the United States and of the state where Simple Brain Games is registered, without regard to conflict-of-law rules. The courts of that state will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in the courts of your country of residence or provides other protections.

14. Changes to these Terms

We may update these Terms for legal, security, technical, or business reasons. We will post the updated Terms here and revise the effective date. If a change materially affects your rights, we will provide additional notice where required. Continuing to use the Services after the updated Terms take effect means you accept them, where permitted by law.

15. General

If any part of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. We may transfer these Terms as part of a reorganization, merger, acquisition, or sale of assets; you may not transfer your rights or obligations without our consent.
